I, hereby known as renter, agree to rent from, [sit.ownername], hereinafter known as owner, the Vacation Property located at 1625 Mooncrest Drive, Alta Sierra, CA 93285.
PAYMENTS
Stoney's Cabin accepts Visa, MasterCard, Discover, and AMEX credit cards for making deposits and payments. Stoney's CAbin DOES NOT accept payments by check or mail. Your Security Deposit is due when making your reservation. Your Full Rental Payment is due within one week prior to your arrival date.
SECURITY DEPOSIT
Your $300.00 security deposit includes a non-refundable cleaning fee. The remainder of your security deposit will be held pending determination that upon departure you have left the unit and contents in the same condition they were upon arrival, and there are no outstanding charges i.e. extraordinary cleaning services, repairs, etc. that are not considered normal wear and tear, at which time it will be returned to you, less any charges, within 2 - 3 weeks from departure. Full rental payment and this agreement must be received prior to check-in. If determined that smoking or pets were allowed inside the home, your entire security deposit will be forfeited.
RENTAL PAYMENT
Your full rental payment is due within one week prior to your arrival date. You may call or check-in via website one week prior to your arrival date to make rental payment.
CANCELLATION & REFUNDS
The policy is as follows: 30 days or less – forfeiture of entire security deposit. Over 30 days - Security deposit will be refunded less a 5% processing fee.
CHECK-IN/OUT
Check-in time is after 3:00 PM on your arrival date. Check-out time is 11:00 AM on your departure date. Any exceptions must have prior approval from manager or owner. You are required to call the manager or owner and make arrangements for key access before your arrival. Upon making your reservation, you will receive an email with contact information so you can contact the site manager.
RULES & REGULATIONS
In order to preserve the integrity of the unit, we ask that it be occupied in a quiet and dignified manner, protecting the premises and its contents against damage, loss or theft with adherence to all the rules and regulations of the applicable Lake Isabella Community and surroundings. Its property owners all inclusive will not be liable for any claims, suits, damages, costs, losses and expenses arising from injury to any person or property occurring on or about the premises relating to the rental of this property. NO SMOKING INSIDE THE HOME IS PERMITTED. Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
A. Occupancy exceeding the sleeping capacity stated on the reservation confirmation. Under no circumstances, will capacity be allowed in excess of 12 persons.
B. Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age.
C. Causing damage to the premises rented or to any of the neighboring properties.
D. Any other acts which interferes with neighbors' right to quiet enjoyment of their property.
E. Unauthorized access and/or tampering of any garage or other storage facilities located on premises. These facilities are NOT included in this agreement and are off limits to tenants. These facilities are exclusively used by owner.
FIRE CAUTION: The cabin is in the middle of the Sequioa National Forest. Renters are to use common sense and err on the side of extreme caution while having outdoor campfires or fires inside the cabin in either the wood burning stove or fireplace. Renters are liable for any damages incurred to the cabin, forest, and surrounding community. (This can be in the millions of dollars if a fire spreads out of control.)
NOTE: FIRES ARE NOT ALLOWED OUTDOORS ON THE PREMISES DURING THE HIGH OR EXTREMELY HIGH FIRE DANGER SEASON - TYPICALLY STARTING IN MID-JUNE AND LASTING THROUGH THE FALL UNTIL THE FIRST SNOWFALL. CHECK WITH THE KERN COUNTRY FIRE DEPARTMENT FOR FIRE DANGER LEVELS PRIOR TO ARRIVING AT THE CABIN.
FIRES SHOULD BE AVOIDED DURING WINDY DAYS AND NIGHTS. If wind picks up after a fire is started, it should be put out immediately.
ALL fires must be continually supervised by an adult.
ALL fires must be completely put out before retiring for the night. Please use water and or dirt to douse the fire.
QUIET TIME: In order to maintain good relations with Stoney's Cabin's neighbors, QUITE TIMES must be observed as follows:
Weekdays (Sunday through Thursday): Quiet times run from 9 PM to 8AM.
Weekends (Friday, Saturdays, and Sundays only on holiday weekends): Quiet times run from 10PM to 8AM.
During these times, please reduce volumes of audio/visual equipment to a level that would not be disruptive to the neighbors. If Stoney's Cabin management gets any complaints regarding noise levels from neighbors, the security deposit will automatically be forfeited.
DEPARTURES
The property must be vacated by 11:00 AM on the date indicated in order to make it available for future guests. Unless otherwise extended with agreement from manager, the owner or manager shall have the right to take immediate possession of the unit at check-out time. Please leave the keys where designated and lock the cabin upon leaving.
TELEPHONE
The calling plan for the cabin's telephone allows for unlimited local and long distance use within the continental United States. Please do not make any calls outside the continental United States, otherwise you are welcome to use the telephone freely.
PAY-PER-VIEW
Pay-per-view movie fees will extracted from your deposit, along with your cleaning fee, after your departure.
KEYS
Replacement cost: $10 each
PETS
We do not allow pets inside the home. Any pets found inside premises or any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the tenant's entire security deposit.
HOUSEKEEPING
Housekeeping service during your stay is available for an additional fees at a rate of $25.00 per hour. You must notify the manager when you would like the housekeeper to stop by. Housekeeping includes washing towels, linens, vacuuming, and making beds. It does not include personal items such as clothing.
CLEANING
The property will be inspected, sanitized and cleaned after your departure. The rental fee you have paid will provide for two hours of normal cleaning so that you can enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit. Additional cleaning services can be arranged directly with the site property manager for a rate of $25.00/hour. It is up to the renter to arrange with the site manager in advance if any services above and beyond the basic post-departure cleaning are desired.
BATH AND KITCHEN TOWELS
Nominally, eight (8) sets of towels/hand towels/wash clothes are laid out for stay. If you wish up to twelve (12) sets of towels, there is no extra charge. However, it is up to the renter to coordinate this with the site manager/housekeeper. Guests will be charged for any missing towels and this amount will be subtracted from renter's security deposit. The fees for lost/stolen/ruined towels is as follows: bath towel: $25; hand towel: $15.00; wash cloth: $10.00. Similarly, guests will be provided with 6 sets of kitchen towels and dishwashing clothes. Any missing/stolen/ruined kitchen towels or wash clothes will be billed to the renter as follows: towel: $10.00; wash cloth: $5.00. TOWELS ARE INTENDED FOR USE AT THE CABIN AND ARE NOT PROVIDED FOR OUTDOOR ACTIVITIES SUCH AS WHITE WATER RAFTING, CAMPING, BOATING, ETC.
EXCESS TRASH
Guest are entitled to nominal amounts of trash and refuse based upon length of stay. Trash shall be placed in the shed along the side of the cabin. For long duration visits, please coordinate with the Housekeeping service for pickup of trash during your stay. Upon departure, please place any remaining trash in the shed. If there is more trash than will fit in the shed, please take precautions to make sure that trash bags left inside the cabin are not leaking. Excess trash will be billed at a minimal cost of $5.00 per large bag.
ADDITIONAL TERMS AND CONDITIONS
The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
ADDITIONAL DAMAGE CHARGES
By entering into this rental agreement, yoiu hereby authorize the owners of Stoney's Cabin to assess charges to your credit card for theft, excessive cleaning, or damages beyond normal wear and tear.
RIGHT OF REFUSAL OF SERVICE
Stoney's Cabin reserves the right to refuse service to any one at any time. Upon such cancellation of service, a refund of the security deposit, less fees, will be credited back to the original paying account credit card on file. Cancellations of reservations could take place even after security deposit is paid. This Right for Refusal of Service is intended to protect Stoney's Cabin from potential loss of income or property damage by unreputable renters and their agents.

This rental agreement must be accepted and received one week prior your arrival date along with your payment.
